These Terms govern your access to and use of the ProPickz platform, including all content, tools, picks, projections, and related services. By accessing or using the Service, you agree to be bound by them. If you do not agree, do not use the Service.
1Informational Purposes Only
All content provided by Propickz — including but not limited to sports picks, projections, analyses, educational materials, and commentary — is strictly for informational and entertainment purposes. Nothing on the platform constitutes financial, investment, or gambling advice. You are solely responsible for any decisions you make based on the information provided.
2No Guarantee of Profit
Past performance does not guarantee future results. Sports betting involves inherent risk, and no system, model, or strategy can guarantee profit. Propickz makes no representations or warranties that the use of our picks or tools will result in financial gain. All users assume full responsibility for their betting activity.
3Content May Include Simulations
Certain results, projections, or performance metrics displayed on the platform may be based on hypothetical, backtested, or simulated data. These are provided for educational and illustrative purposes only and do not reflect actual user results. Simulated results have inherent limitations and should not be relied upon as indicators of future performance.
4No Client/Fiduciary Relationship
Use of the Propickz platform does not create a client, advisory, fiduciary, or professional relationship between you and Propickz or any of its affiliates. Propickz is not a licensed financial advisor, broker, or betting service provider.
5Limitation of Liability
To the fullest extent permitted by applicable law, Propickz and its owners, officers, employees, agents, and affiliates shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, or other intangible losses — arising out of or in connection with your use of the Service.
6Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. Propickz disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
7Intellectual Property
All content, branding, models, algorithms, tools, designs, and materials on the Propickz platform are the intellectual property of Propickz. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without prior written consent.
8Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada.
9Changes to Terms
Propickz reserves the right to modify or update these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
10Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
11Entire Agreement
These Terms, together with any other legal notices or policies published on the platform, constitute the entire agreement between you and Propickz regarding the use of the Service.
12Guarantee Disclaimer
Propickz offers a performance-based guarantee on select membership tiers. The following outlines the scope, conditions, and limitations of this guarantee.
12.1Scope
The guarantee applies only to paid membership tiers that explicitly advertise a guarantee as part of their plan. Free or community-tier memberships are not eligible.
12.2Definition of Loss
A “loss” under this guarantee is defined as a negative unit balance at the end of the applicable guarantee period, calculated using flat-unit betting at the recommended unit size, based solely on picks published by Propickz during the membership term.
12.3Membership-Specific Guarantees
- Monthly Membership
- If the member finishes the calendar month at a net loss (in units), Propickz will refund that month’s subscription fee and extend the membership by one (1) additional month at no charge. Both apply; they are not alternatives. The guarantee runs every billing cycle and is not limited to the first.
- Yearly Membership
- If the member finishes the twelve (12) month period at a net loss (in units), Propickz will extend the membership by one (1) additional month at no charge.
- Lifetime Membership
- Lifetime members are not eligible for extensions, as their access is already perpetual. However, Propickz commits to maintaining service quality and transparency for all lifetime members.
12.4Member-Initiated Claims
To claim a guarantee extension, the member must contact Propickz support within fourteen (14) days of the end of their billing period. Claims must include the member’s username, membership tier, and the relevant billing dates. Propickz will review the claim using internal tracking records.
12.5Exclusions
The guarantee does not apply if:
- The member did not follow the recommended unit size or bankroll management guidelines.
- The member selectively tailed picks rather than following the full card.
- The member’s account was suspended or terminated for violating platform rules.
- The member requested a refund or chargeback during the guarantee period.
12.6Guarantee Limitation
The guarantee is limited to service extensions only. Under no circumstances will Propickz provide monetary refunds, cash compensation, or reimbursement of betting losses. The guarantee is a goodwill gesture and does not constitute a contractual obligation to ensure profitability.
12.7No Workarounds
Any attempt to manipulate, abuse, or exploit the guarantee — including but not limited to creating multiple accounts, falsifying records, or misrepresenting betting activity — will result in immediate disqualification from the guarantee and potential termination of membership.
